TITUSVILLE, Fla. — Titusville police officer Joshua Payne has been arrested on manslaughter charges following a Florida Department of Law Enforcement investigation into a shooting that resulted in the death of a man during a pursuit in December.

Payne, 29, of Winter Park, turned himself in at the Brevard County Jail on Wednesday and was scheduled to post $15,000 bond. The case will be prosecuted by the State Attorney's Office for the 18th Judicial Circuit. No trial date has been scheduled.

Payne was immediately placed on unpaid suspension pending the results of an internal investigation.

The shooting occurred Dec. 26, when Payne tried to stop a man who matched the description of a suspect in a domestic battery case, the FDLE reported. That man was later identified as James Lowery, 40.

Lowery fled and Payne pursued him on foot. According to the investigation, Payne tried to stop Lowery by deploying his stun gun multiple times, but it was ineffective. Lowery climbed over the gate of a nearby fence and threw an object over the fence, and Payne drew his firearm and repeatedly ordered Lowery to stop and get down, the report said. When Payne reached the fence holding both the stun gun and his firearm, with Lowery on the other side of the fence, evidence indicates that Payne simultaneously pulled the trigger of the stun gun and his firearm, striking Lowery in the back of the head, according to the FDLE investigation.

Lowery was pronounced dead at the scene, the report said.

No weapons were found on Lowery or in the vicinity, the FDLE report said.
