KISSIMMEE, Fla. — A federal civil rights violation lawsuit is being filed against Osceola County Sheriff Marcos Lopez and two of the agency’s deputies.

Lawyers for the family of Jayden Baez are seeking answers, more than a year after he was shot and killed in a Kissimmee Target parking lot by law enforcement.

The lawsuit is expected to be filed in the coming days, alleging that not only did deputies at the scene use excessive force but that the sheriff’s office also falsified reports about the incident after the fact.

Alejandro Baez, the father of Jayden Baez, shared on Tuesday in a press conference that he s still struggling with the loss of his son and is hoping this lawsuit brings justice for him and the others involved in this.

“I will never know what it means too be called abuelo, grandpa, so the truth has to come out and I believe it will come out,” said Baez.

He describes his son as his best friend and has his portrait tattooed on his hand.

“He used to tell me "Dad I am a fly", and I would say well who told you that? and he said "The mirror”, joked Baez.

Jayden was shot and killed last April in the parking lot of a Kissimmee Target. One other person was maimed, and another was shot in the back after deputies fired at them through the windshield of a car.

Authorities say two suspects had shoplifted about 46 dollars worth of pizza and Pokemon cards from the store. Target employees alerted the deputies who were conducting field training exercises in the parking lot, who later opened fire.

“This is something I wouldn’t want no parent to go through, regardless of what the situation, what happened, for Pokemon cards and pizza?" said Baez. "That’s not good and as a father having his oldest child killed like that is something I live with everyday."

Lawyers are planning to file a federal lawsuit claiming the sheriff’s office has been covering up some events that led to the shooting, as there is a no-chase policy in Osceola County, especially for a non-violent misdemeanor.

“We just want to get to the bottom of it," said Mark Nejame, the attorney filing the lawsuit. " We know that what was done here was wrong this situation was created by law enforcement, they used these young men as guinea pigs for conducting a lethal operation to stop a car knowing that consequences could be dangerous and they were.”

Nejame shared that the state attorney Monique Worell and her team have issued subpoenas to two deputies involved: Scott Koffinas and Ramy Yacoub.

"We know that what was done here was wrong this situation was created by law enforcement, they used these young men as guinea pigs for conducting a lethal operation to stop a car knowing that consequences could be dangerous and they were,” said Nejame.

Spectrum News 13 spoke with criminal defense attorney Johnathan Rose about the claims in this suit.

“If there was no actual crime that was being committed that was a forcible felony and that is what they did — that is a huge problem and I will be very interested to see if that is in fact what happened,” said Rose.

He claimed he’s never seen anything like this in his career.

“… and they just decide to use these unwitting people as the basis for their training exercise and allegedly follow them around the store and ram into their car…. That is what is alleged in the complaint if that is true that is baffling to me and probably creates some pretty serious liability for both the sheriffs office and Target,” said Rose.

As for Baez, he wants those responsible to pay.

"...the only thing that can come out of this good is justice for the victims,” said Baez. 

Nejame also alleges that Osceola County Sheriff Marcos Lopez has been vocal about wanting Worrell removed from this case, calling on Governor DeSantis to support her efforts.

OCSO issued a statement saying that they’re looking forward to the completion of the state attorney’s review so all parties can gain some closure regarding this incident.
