COCOA, Fla. — A Cocoa Police Department officer is facing aggravated assault with a deadly weapon and other charges, after a judge ruled that he should be held in jail without bond on Thursday morning, according to records.
According to a statement from Cocoa Police Chief Evander Collier IV, Brevard County Sheriff’s Office SWAT team responded to Officer Patrick Michael Kelly’s home in Viera on December 28 around 10:30 p.m., where he was involved in a domestic disturbance with another Cocoa police officer. Kelly was armed and was actively shooting inside of the home, the report states. But after several hours, the chief says Kelly surrendered without further incident. There were no injuries.
Kelly, 39, is facing the following charges: Aggravated assault with a deadly weapon without the intent to kill and discharging a firearm in public or in residential property, according to a probable cause affidavit.
Chief Collier also said Kelly was previously arrested back in 2017 for felony domestic violence battery. After those charges were dropped, Kelly was allowed to remain with the department. He is currently suspended without pay, pending termination after being with the department since December 2007.

"Cocoa Police Officers are held to the highest levels of professional and moral conduct and Officer Kelly’s actions do not represent the men and women of this agency who take pride in their job every day to protect and serve our community," said Police Chief Collier in the statement.
Chief Collier went on to thank Brevard County Sheriff's Office for their quick response to the incident and said the Cocoa Police Department will move forward by providing support to the Cocoa police officer and victim who shared the home with Kelly.
