DAYTONA BEACH, Fla. — A 78-year-old New Smyrna Beach woman who shot and killed her terminally ill husband while he was being treated at the hospital in 2023 was sentenced to 366 days in prison Friday.
Ellen Gilland had pleaded no contest to four charges: manslaughter with a firearm and three counts of aggravated assault with a deadly weapon.
She shot and killed her 77-year-old husband, Jerry Gilland, while he was being treated at AdventHealth Hospital in Daytona Beach on Jan. 21, 2023.
According to Daytona Beach Police Chief Jakari Young at the time, Gilland and her husband had planned the shooting.
"They had a conversation about it and they actually planned this approximately three weeks ago, that if he took a turn for the worse that he wanted her to end this," Young said in 2023. "Obviously, we're unsure how she brought the gun into the hospital, but this was planned."
Gilland was arrested after a standoff with police that lasted several hours and was initially charged with first-degree murder. That charge was later changed to assisting in self-murder, before again changing to manslaughter with a firearm in her plea.
She was held at the Volusia County Jail for 42 days, and she will get credit for that as time served on her sentence.
A no contest plea means Gilland did not dispute the evidence presented by prosecutors, but did not admit guilt in her husband's killing.
After her prison sentence is completed, Gilland will be on probation for 12 years. She will also have to complete eight hours of community service every month for as long as she is able.
