SEMINOLE COUNTY, Fla. — A Seminole County judge has granted a temporary injunction Thursday against a Shadow Bay resident who is accused of pouring concrete down a storm drain.

The judge said at Thursday's code enforcement hearing that Diane Goglas has to fix the pipe by Oct. 1, or she’ll start to see a daily fine of $250

Goglas is ordered to fix the pipe within the next 10 days, and if she doesn’t, the judge will authorize the county to go in and do it, and then send her the bill.

According to Goglas’ attorney, her home is one of 10 that are not part of the HOA.

In court, Goglas said she learned the pipe for the drainage was broken and was causing erosion on her property.

She also told the court that Shadow Bay didn’t want to fix it, because the portion of her property that has the drainage pipe is not part of the community’s HOA.

While testifying in court, Goglas explained why she poured concrete in the drainage system.

“My land is still eroding,” Goglas said. “So I didn’t understand how their drains were still working if my land was eroding. I just couldn’t comprehend that.”

After closing arguments, the judge said that Goglas is responsible for her actions. HOA members who were on hand didn’t want to speak, but let their attorney comment about the outcome.

“The ultimate goal is to get the system back in to operations as quickly as possible, especially with the possibility of a storm approaching,” attorney Barbara Stage said after the ruling.

During the hearing, the judge asked Goglas if she had received bids yet to fix the pipe. The defendant then asked the judge to make a call in the courtroom, either dialing an engineer or contractor who was at her house to provide a bid.

Following the call, she informed the judge the bid is in the works as an engineering report is needed, the contractor’s construction costs need to be worked out, and both county permits and approval as well.
