CLERMONT, Fla. —In an order filed Monday, Circuit Judge Lawrence Semento quashed the conditional-use permit that the City of Clermont granted for a charter school at a busy Clermont intersection.

Clermont resident Danielle Page filed a petition on November 6 asking the court to overturn the permit the Clermont City Council granted on October 9 to Seven Lakes Preparatory Academy. 

According to Page, a big concern among residents was increased traffic at an already busy intersection. 

“When the council made their decision they didn't utilize their own city code," she said. 

According to court documents, the judge in the case determined the city failed to comply with due process, and that some of the facts were not supported by evidence.

Later on in the order, Semento explained that “the discussion of the commissioners and mayor in the transcripts from October 9 meeting seem to suggest that they ignored the potential traffic problems rather than addressing them as required by the code ... ”

The city has 30 days to appeal. A spokeperson gave Spectrum News 13 the following statement:

"We continue to maintain that the City Council’s ruling was correct. We will request a rehearing to seek clarification on the court’s decision, especially as it relates to the conditional use permit review process."
