SAN ANTONIO — Texas Attorney General Ken Paxton is suing the City of San Antonio in state court, after the City Council narrowly voted to allocate $100,000 for abortion travel funds.
In the lawsuit, Paxton claims the city is “transparently attempting to undermine and subvert Texas law and public policy.”
In October 2023, the City of San Antonio faced a lawsuit from anti-abortion groups after allocating $500,000 to establish a “Reproductive Justice Fund” in its annual budget.
This fund did not include provisions for covering travel expenses for out-of-state abortions, but focused on services such as access to contraceptives, prenatal care, sexually transmitted infection (STI) testing and reproductive health workshops. According to the San Antonio Express-News, the $100,000 additional funds would be spent to help women seeking out-of state abortions.
This is one of several lawsuits Paxton has filed, rooted in his commitment to enforcing Texas’ stringent anti-abortion laws.
Following the 2022 repeal of Roe v. Wade, Texas implemented a near-total abortion ban, prompting some municipalities to seek ways to support residents needing access to abortion services. Paxton’s lawsuits aim to prevent local governments from circumventing state laws through financial assistance programs.
In September 2024, Paxton sued the City of Austin, challenging its allocation of taxpayer funds to assist residents seeking out-of-state abortions.
