ORLANDO, Fla. — The Orlando Police Department on Wednesday released the video from the body-worn camera of the officer-involved shooting on July 3 in the area of Jefferson Street and North Orange Avenue, resulting in the death of Derek Diaz.

Before the video was released publicly, department officials met with Diaz's family and their attorney.

"I express my sincere condolences to the Diaz family on the loss of their loved one," Orlando Police Chief Eric D. Smith said in a statement. "We understand the need for answers. Maintaining the integrity of the investigation process is also needed so that the facts are provided fairly and transparently. An investigation not only involves body worn camera video of the incident but also includes the collection of witness testimony, evidence, and other materials."

Diaz, 26, was shot during a proactive patrol stop, Orlando police said. Officers were concerned about suspected drug activity in the area, police said.

"Our officers proactively patrol to remove illegal drugs and crime guns off our streets," Smith said in the statement Wednesday. "At the intersection of this incident, there were 431 incidents in the last 18 months."

According to officers, Diaz "disobeyed the commands (given to him by officers) and made a movement as if to retrieve a gun." 

Diaz's actions prompted an officer to shoot, according to officers.

Diaz was taken to a nearby hospital, where he died.

Officers found drugs but have not recovered a weapon, Smith said in an earlier statement.

Derek Diaz’s family and attorney Benjamin Crump say seeing the video only raises more questions about the shooting, including why Diaz was pulled over in the first place.

“An unarmed Derek Diaz was sitting peacefully in a legally-parked car when he was aggressively approached by three armed police officers, and in less than one minute he was shot and bleeding,” said Natalie Jackson, an attorney representing the Diaz family.

Diaz’s family is now preparing for his funeral as they try to console Diaz’s five-year-old daughter.

“I did tell her yesterday that he did pass away, and she was upset – she did cry – but she’s five years old, I think she’s taking it a bit better than the adults,” said Sonja Nava, the mother of Diaz’s daughter.

The officer has been placed on administrative leave while the investigation is pending. The Florida Department of Law Enforcement will conduct an independent review of the shooting, followed by the State Attorney’s Office.

"Since the incident happened, the Orlando Police Department has been cooperating with the FDLE investigation, and we will continue to do so as we are all committed to a thorough and transparent review of this case," Smith said in the statement.

The OPD also is conducting its own investigation.
