A road rage incident in New Smyrna Beach Tuesday put one man behind bars.
Police said Brandon Cook and Thomas Tipton got into an argument as the two tried to avoid debris on the road in the area of Park Avenue and State Road 44.
Cook said Tipton fired a shot at his side door.
"When he pulled up along side of me, I seen him reach for something in the passenger seat and by the time he came up midways I seen it was a gun," Cook said. "I had a drink, I threw it through my window, it hit him, gave me enough time to put my truck in drive and speed out of there."
Tipton is in jail tonight charged with attempted murder.
