The Orlando Police Department has fired an officer for a shooting incident in a downtown Orlando parking garage last year.

Officer David Johnston was indicted by an Orange County grand jury last year for the shooting on Feb. 24 in a parking garage at the City View Apartments on West Church Street while Johnston and two other officers were attempting to arrest Derrick Lattimore.

A report said Lattimore sped off when approached by the officers, almost hitting one of them. As Lattimore traveled down the parking garage, Johnston used an assault rifle to fire 23 shots at the car from about 88 feet away.

The police department's decision to fire Johnston was based on an internal investigation into his actions, saying he violated two department regulations.

Meanwhile Johnston is still facing criminal charges of shooting into an occupied vehicle and discharging a firearm in public.
