The State Attorney's Office won't prosecute the U.S. Marshal who shot and killed a fugitive last year in Flagler County.

According to the Flagler County Sheriff's Office, deputies and the U.S. Marshals Fugitive Task Force were attempting to serve a fugitive warrant Aug. 13, 2014, at a home in Espanola, near the intersection of County Road 13 and County Road 205, west of U.S. Highway 1.

During the warrant service, deputies said, a U.S. Marshal shot 24-year-old Corey Tanner.

Tanner died at the scene.

"Based on our review of the investigation and the information provided, no further action is warranted by this office," State Attorney R.J. Larizza wrote in a Jan. 22 letter to the Florida Department of Law Enforcement.

The U.S. Marshals Fugitive Task Force was attempting to take Tanner into custody for his involvement in a July shooting in Bunnell. He was charged with attempted first-degree murder, aggravated assault with a firearm and aggravated assault.
