Right now, a saggy pants ordinance is under fire in Marion County, just one month after it was approved.

Criticism is coming from from civil rights groups, residents and even from the Mayor who signed the law.

The City Council says it's keeping the law as it stands, but News 13 has learned police have no plans to enforce it; at least for now.

“I don’t like the way it looks I think it looks absolutely terrible, but they need to have a way to express themselves" said Double.

Had they come with her Wednesday to Ocala’s Splash park, technically they could have been arrested.

Ocala’s City Council last month passed a law prohibiting anyone on city property including streets and sidewalks from wearing their pants so it exposes skin below their waist or two inches of their underwear. Violators of the law are supposed to be arrested and face a Judge who could sentence them for up to 60 days in jail or a $500 fine.

Tuesday night Mayor Kent Guinn asked the city council to reconsider. He told me he thought the ordinance overstepped the rights of government. The Council had previously unanimously approved the ordinance and decided not to bring it back up for a vote.

“Maybe they are being stubborn maybe they don’t want to admit that they made a mistake it just seems like a silly law and it seems like we have a lot more to worry about,” said Ocala resident Ralph Demilio.

Civil Rights leaders from across the state were in town to discuss the ordinance and the NAACP has said it will consider everything from legal challenges to potential boycotts, because of the ordinance’s potential use for profiling.

Some feel police would able to use the law to stop someone just because of their pants, while suspecting another crime and use it to get an arrest.

But with the debate raging on, and at least one Council member saying they might be in favor of changing penalties for violators to a ticket rather than a arrest, police say for now they’ll just look the other way.
